My late father left behind a Rs 20L personal loan but his total assets are only Rs 15L. Will the bank seize my personal savings?

My father suddenly passed away last month. While going through his finances, we discovered he had an outstanding unsecured personal loan of Rs 20L.

His total estate (bank balance and some FDs) only adds up to about Rs 15L.

The bank is calling us to settle the dues.

Under Indian law, a legal heir's personal assets cannot be attached to recover a deceased person's unsecured debts. Your liability is strictly limited to the value of the estate you actually inherit from him.

Since his total estate is valued at Rs 15L, you will use that entire Rs 15L to pay down the outstanding personal loan. The remaining Rs 5L shortfall is legally the lender's problem, and the bank will have to write it off. You do not have to pay a single rupee of that remaining balance from your own salary or personal savings.

The only exception to this rule is if you were signed on as a co-borrower for that specific personal loan. If you were a co-borrower, you are legally responsible for the entire outstanding amount, and your personal assets could be attached if you default. But if you were merely a nominee or a legal heir, the bank cannot force you to cover the gap out of pocket.

For secured liabilities like home loans, the rules are slightly different because the property itself is collateral. Most modern home loans are covered by term life insurance that pays off the balance, transferring the property debt-free. But for unsecured personal loans, your financial risk ends exactly where the inherited estate's value ends.
